In maintaining confidentiality, you should be aware that it might be possible to identify an individual even when personal identifiers such as name, address, date of birth etc have not been used. In sharing personal information you should be sure that you have the authorisation to share information and that you are following any organisational procedures or information sharing protocols that are in place.
We should be open and transparent in how we use personal information. This means that people should be made aware of how we use information about them and the circumstances under which it might be disclosed.
Information should be used and shared with consent wherever possible. Consent should be informed, there must be a degree of choice, and there should be an indication that consent has been given. Lack of consent should not prevent the sharing of information where there are concerns about the welfare of an individual.
Even where there are grounds for sharing information without consent it is good practice to ask permission to share that information unless it would prejudice the investigation of a crime or would put the individual at risk of harm. It may be necessary to share information where consent is withheld, the individual should be informed this is what you intend to do
Where the individual does not have the capacity to consent, decisions to share information are the responsibility of the agency giving care. Decisions to share should be made in the best interests of the client, taking into consideration any previously expressed views and the views of carers
